SMSF Upgrades - is your SMSF deed compliant?
There have been extensive changes in superannuation over the past 10 years and in order to maximise the benefits of superannuation it is important to ensure your SMSF deed are up-to-date with latest legislation.
The most significant changes in superannuation legislation was with the introduction of the Simpler Super reforms in July 2007 which changed vital areas such as contributions and contribution splitting, employment of members in the fund and tax advantages through transition to retirement arrangements and pensions. As a result, virtually all SMSFs established prior to 1 July 2007 require upgrading to take full advantage of these changes, as funds established prior to this date which have not been upgraded are potentially paying additional and unnecessary tax or are not capitalising on the benefits introduced through the Simpler Super reforms.
The benefits of the current superannuation legislation are many and affect how a SMSF is treated in terms of tax and contributions. Therefore if a SMSF deed has not been upgraded the chances are that the members may be missing out on significant benefits, such as:
- Making contributions up to age 65, without the need to meet the work test;
- Having the ability to make contributions up to age 75;
- Members aged 55 or more accessing benefits prior to retirement (known as transition to retirement);

Change of Trustees

When such changes occur an amendment will be required.
Reckon Docs requires a copy of the original deed and all subsequent amendment deeds for any amendments and/or appointments to be processed.

Limited Recourse Borrowing Arrangement
A Reckon Docs 'Limited Recourse Borrowing Arrangement' Package allows trustees to borrow through their SMSF to acquire or invest in assets such as:

There are a number of factors that trustees need to address when considering a Limited Recourse Borrowing Arrangement structure such as:

Investment Strategy
Superannuation laws provide that the trustee of a SMSF must formulate and give effect to an investment strategy for the fund. An appropriate investment strategy should reflect the investment objectives of the fund and detail the investment methods the trustee will adopt in achieving those objectives. When formulating an investment strategy, the trustee may seek written professional advice however overall responsibility remains with the trustee.
The investment strategy must have regard to the whole of the circumstances surrounding the Fund including, but not limited to:
- the risk involved in making, holding and realising, and the likely return from the Fund's or member's investments and the trustee's expected cash flow requirements;
- the composition of the Fund's investments as a whole including the extent to which the investments are diverse or involve the Fund being exposed to risks from inadequate diversification;
- the liquidity of the Fund's investments having regard to its expected cash flow requirements; and
- the ability of the Fund to discharge its existing and future liabilities.
All investment decisions must be recorded in writing and the trustee must ensure that all investment decisions are made in accordance with the investment strategy.

Sole Purpose Trustee Company
Reckon Docs Sole Purpose Trustee Company constitution has been developed to maximise the Trust Deed's full potential. Unlike trading company constitutions, the Sole Purpose Trustee Company constitution includes rules that are relevant specifically to its function as a SMSF trustee.
When the directors of a corporate trustee of a SMSF hold a trustee meeting they are governed by the rules of the constitution of the trustee company, not the rules of the SMSF trust deed. It is therefore important that the constitution contains rules consistent with the trust deed.
The trustee company constitution also contains rules dealing with trustee voting powers, and automatic appointment of executors and legal personal representatives as trustees of the fund that mirror those that are written in the SMSF trust deed. These help the members, acting as trustees, to maintain control over their superannuation.
